Terms of Use

These Terms of Use govern your access to and use of the ITV Odds Finder platform (the “App”), also referred to as ITV Odds.

By creating an account or using the App, you agree to these Terms. If you do not agree, you must not use the App.

These Terms apply to users in the United Kingdom (England, Wales, Scotland and Northern Ireland), the Channel Islands and the Isle of Man. The App may be accessible from other locations but is primarily directed at users in those territories.

The ITV Odds Finder name and associated trade marks are owned by ITV Broadcasting Limited (“ITV”) and is operated by funteron Limited (“funteron”, “we”, “us” or “our”), a company registered in Northern Ireland with company number NI725325, registered office at Unit A4 Harbour Court, 3 Heron Road, Belfast, Northern Ireland, BT3 9HB.

ITV Broadcasting Limited is not a party to these Terms and has no contractual relationship with you in connection with the App or its services.

ITV has no editorial or technical control over the odds displayed, the selection of Operators or the marketing referral mechanisms used by funteron.

ITV is not liable for the App’s availability, for funteron’s services or for any gambling outcomes arising from your use of the App. Any queries about the App or these Terms should be directed to funteron using the contact details in section 19.

ITV may send marketing communications to you if you separately opt in to receive them from ITV. In that case, ITV acts as an independent data controller. See section 13 and our Privacy Notice for further information.

You must be at least 18 years old to create an account or use the App. If you are under 18, you must not create an account, access or use the App in any way.

By registering, you confirm that you are 18 or over and that it is legal for you to participate in gambling in your jurisdiction.

We may request evidence of age verification at any time. We may suspend your account pending satisfactory verification.

If we discover that an account has been created by, or is being used by, a person under 18, we will terminate that account immediately.

If you are registered with GAMSTOP or have self-excluded from gambling with any operator accessible through the App, you should not use the App to access that operator’s services.

The App provides betting odds comparison and referral services only.

The App does not:

• provide gambling services
• accept, hold or process bets
• hold customer funds
• determine betting odds
• settle wagers
• operate a betting exchange
• provide a wallet or account balance
• aggregate balances across operators
• transmit funds between users and operators

The App does not provide facilities for gambling within the meaning of the Gambling Act 2005 or equivalent legislation applicable in Northern Ireland, the Channel Islands or the Isle of Man.

All bets are placed directly with licensed gambling operators (“Operators”) via their own websites or apps. Any betting contract is formed solely between you and the relevant Operator. funteron is not a bookmaker and does not act as a betting intermediary.

Neither funteron nor ITV holds, or is required to hold, a licence from the UK Gambling Commission, the Jersey Gambling Commission, the Guernsey Gambling Control Commission, the Isle of Man Gambling Supervision Commission or any equivalent regulatory authority in connection with the services provided through the App.

The App does not constitute a remote betting intermediary or remote gambling software within the meaning of applicable gambling legislation.

Each Operator accessible through the App holds its own licence from the relevant regulatory authority and is solely responsible for its own regulatory compliance, customer due diligence and responsible gambling obligations.

funteron is a marketing technology service provider. The App is a consumer-facing tool through which funteron delivers marketing and referral services to licensed Operators.

Where the App uses technical integrations or APIs to connect users to Operator platforms, these are marketing referral mechanisms only.

You will be transacting directly with the Operator and subject to the Operator’s own terms and conditions, privacy policy and responsible gambling obligations.

funteron does not act as your agent in any gambling transaction and is not a party to any transaction between you and an Operator.

funteron receives commission from Operators when users are referred to their services via the App, including cost per acquisition and revenue share arrangements.

funteron does not participate in the underlying gambling transaction and does not share in betting outcomes, wins or losses.

By using the App, you acknowledge that funteron may receive referral fees from Operators in connection with your registration with or activity on those Operators’ platforms following a referral via the App.

funteron’s commercial arrangements with Operators do not affect the odds displayed in the App or the items available to you from any Operator.

You must provide accurate, current and complete information when creating an account.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must notify us immediately if you become aware of any unauthorised use of your account.

We may suspend or terminate your account if you breach these Terms, provide false information or if we are required to do so by law or regulation.

You agree that you will not:

• use the App unlawfully or in breach of these Terms
• provide false or misleading information when registering or using the App
• attempt to circumvent any age verification or identity checks
• use the App if you have self-excluded from gambling and are seeking to access an Operator from which you are excluded
• interfere with or disrupt the App’s security, infrastructure or functionality
• scrape, copy, reverse engineer or republish any part of the App
• use the App to develop, operate or promote any competing betting odds comparison service
• access the App using automated tools, bots or scripts without our prior written consent

The App is an odds comparison service. It does not accept bets or provide gambling services. However, we recognise that gambling carries risk for some users and we take our responsibilities seriously.

GAMSTOP is a national self-exclusion scheme operating in Great Britain. Users in the Channel Islands or Isle of Man should contact their local gambling regulator or use Gambling Therapy to access self-exclusion tools.

Each Operator accessible through the App is independently licensed and is required to provide responsible gambling tools including deposit limits, cooling-off periods and self-exclusion. We encourage you to use those tools if needed.

If you have self-excluded from GAMSTOP or via any individual Operator, you must not use the App to attempt to access that Operator’s services.

The App contains links and technical integrations to third-party Operator websites and platforms.

We do not control Operator services and are not responsible for their content, availability, accuracy or terms.

You should review each Operator’s terms and conditions, privacy policy and responsible gambling information before registering or placing a bet.

funteron does not guarantee the accuracy or currency of odds displayed. Odds are supplied by Operators and may change without notice.

funteron acts as Independent Data Controller for personal data collected through the App, with limited exceptions set out in our Privacy Notice. Our Privacy Notice explains how we collect, use and share your data and is incorporated into these Terms by reference.

The App does not collect:

• gambling transaction history or betting activity data
• payment details or bank account information
• identity verification documents
• special category data

Such data is collected directly by Operators under their own privacy policies and is outside funteron’s control.

ITV Odds Finder marketing

If you opt in, funteron may send you marketing communications about betting odds, promotions, App updates and related services. You may withdraw consent at any time.

Opting into funteron’s marketing communications does not automatically opt you in to ITV’s marketing communications.

ITV marketing

If you separately opt in to receive marketing from ITV:

• your registration details (name, email address and mobile number) will be shared with ITV
• ITV will act as an independent Data Controller in respect of that data
• ITV will process your data in accordance with its own Privacy Notice
• you may withdraw your consent at any time

Your choice regarding ITV marketing does not affect your access to the App or funteron’s marketing.

The App is provided on an “as is” and “as available” basis.

We do not guarantee:

• uninterrupted or error-free availability of the App
• that all odds are accurate or current at all times
• the accuracy of any data, content or service
• that Operator services will be available or compliant

Odds are supplied by Operators and may change without notice. The App reflects odds as received and does not independently verify them.

To the extent permitted by law:

• we are not responsible for gambling outcomes provided by Operators
• we are not liable for losses arising from bets placed with Operators
• we are not liable for indirect, consequential or economic losses

Nothing in these Terms excludes or limits our liability for:

• death or personal injury caused by our negligence
• fraud or fraudulent misrepresentation
• any other liability that cannot be lawfully excluded

If you are a consumer resident in Scotland or Northern Ireland, nothing in these Terms affects your statutory rights as a consumer.

ITV’s contractual liability is limited as set out in the contract between funteron and ITV. ITV’s contribution to use of the App is at its discretion.

We may suspend or terminate your access to the App if:

• you breach these Terms
• we are required to do so by law or regulatory authority
• it is necessary to protect the integrity, security or operation of the App

You may delete your account at any time by contacting us using the details below.

We may update these Terms from time to time. Material changes will be notified within the App or by email.

Continued use of the App after a change has been notified constitutes your acceptance of the updated Terms.

We may modify, suspend or discontinue any aspect of the App at any time. We will give reasonable notice where practicable.

These Terms are governed by the laws of England and Wales.

Disputes are subject to the jurisdiction of the courts of England and Wales. If you are resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
